Terms of Service
Terms of Service for Website Design and Custom Graphic Design Services Effective Date: March 28, 2026
Acceptance of Terms
By transferring the deposit for the stated scope of work, you ("Client") agree to be bound by these Terms of Service ("Terms") for website design and custom graphic design services provided by [Your Company Name] ("Provider") using the Fourthwall platform.
Scope of Services
2.1 Website Design and Setup:
Design and setup of a fully functional online store on the Fourthwall platform
Initial build of up to 25 products/services
Custom theme and branding implementation
Integration of necessary apps and features
2.2 Custom Graphic Design (Add-on Service):
Creation of custom all-over print designs
Designs applicable to any product in Fourthwall's catalog
Project Timeline and Pricing
3.1 Project Duration: 3 weeks from the date of deposit receipt
3.2 Total Project Cost: $650 - $1,350, broken down as follows:
Design and Setup Fee: $650
Per-Product/Service Configure Fee: $15 x 25 products = $375
*Add-on: Custom Graphic Design: $325 (includes 3 all-over print designs)
Payment Terms
4.1 A non-refundable deposit of 50% (total price based on needs within the $650 - $1,350 project price offer) is required to initiate the project.
4.2 The remaining balance is due upon project completion and before the website goes live.
Client Responsibilities
5.1 Provide necessary content, including product information and images, within 5 business days of project initiation.
5.2 Review and provide feedback on designs within 3 business days of submission.
5.3 Obtain necessary rights and permissions for all content provided to Provider.
Provider Responsibilities
6.1 Deliver all project components as outlined in the proposal.
6.2 Maintain regular communication with Client throughout the project.
6.3 Make reasonable revisions based on Client feedback (up to 2 rounds of revisions per deliverable).
Intellectual Property
7.1 Client retains ownership of all content provided to Provider.
7.2 Provider retains ownership of any pre-existing materials/ custom designs used in the project.
7.3 Upon full payment, Client receives full ownership to the custom designs created for this project.
Fourthwall Platform Terms
8.1 Client acknowledges that the online store will be subject to Fourthwall's terms of service and transaction fees (2.9% + $0.30 per sale).
8.2 Provider is not responsible for any changes to Fourthwall's pricing or policies.
Limitation of Liability
Provider's liability is limited to the total amount paid for services under this agreement.
Termination
10.1 Either party may terminate this agreement with written notice if the other party breaches a material term of this agreement.
10.2 In the event of termination, Client is responsible for payment of all services rendered up to the termination date.
Modifications
These Terms may only be modified in writing, signed by both parties.
Governing Law
These Terms shall be governed by and construed in accordance with the laws of New York State. By transferring the deposit for the stated scope of work, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service
